RESOLUTION

The Conference recognizes the discrepancy between the English version and the other two versions of the Protocol as contained in Article 11 (1) (c) of the Final Act of 1990, since "including" in the English version is expressed as the equivalent of "which may include" in the French and Spanish versions.

Consequently the Conference:

  1. Agrees that the chapeau of Article 11(l)(c) is to read as follows:

    "Each party shall adopt appropriate measures to ensure the protection and recovery of species of flora and fauna listed in Annex III and may regulate the use of such species in order to ensure and maintain their populations at optimal levels. With regard to the species listed in Annex 111, each Party shall, in co-operation with other Parties, formulate, adopt and implement plans for the management and use of such species, which may include:"

  2. Requests the Depository to proceed as established under Article 79 of the Vienna Convention on the Law of Treaties to make the necessary adjustments to the English and French texts.
